In the early 1960s, the world stood closer to nuclear catastrophe than at any point before or since. The Cuban Missile Crisis of 1962 brought the United States and the Soviet Union to the brink of war, while atmospheric nuclear tests scattered radioactive fallout across the globe. Out of this fear emerged two landmark agreements: the Partial Test Ban Treaty (PTBT) of 1963 and the Nuclear Non-Proliferation Treaty (NPT) of 1968. These treaties represent the first serious, coordinated attempts to put limits on the most destructive weapons ever created. Understanding them is essential to grasping how the Cold War’s nuclear rivalry was gradually brought under a framework of rules.

The road to the partial test ban treaty
By the late 1950s, nuclear testing had become an environmental and public health emergency. The United States, the Soviet Union, and the United Kingdom were detonating ever-larger bombs in the atmosphere, releasing radioactive particles that spread worldwide through wind and rain. A famous study in Missouri analysed hundreds of thousands of shed baby teeth and found alarming levels of strontium-90, a radioactive isotope, in children born during the period of intensive testing. The danger was no longer abstract; it was entering human bodies.
Interestingly, the first push for a ban came not from a superpower but from India. India made the earliest call for a test ban as far back as 1954, reflecting a long-standing commitment to disarmament under Prime Minister Jawaharlal Nehru. Formal negotiations began in 1958, when the three nuclear powers opened a conference in Geneva. Those talks stalled over the question of verification, since the powers could not agree on how to detect and monitor underground explosions reliably.
The Cuban Missile Crisis changed the political mood. Having stared into the abyss, the leaders of both superpowers became newly motivated to find common ground. The crisis demonstrated that mutual restraint was not just idealism but a practical necessity for survival.
What the PTBT actually banned
Signed in Moscow on 5 August 1963 by the United States, the Soviet Union, and the United Kingdom, the PTBT entered into force on 10 October 1963. The treaty is also known as the Limited Test Ban Treaty (LTBT). Its core achievement was prohibiting nuclear weapons tests in three environments: the atmosphere, outer space, and underwater. The treaty’s central purpose was ending the contamination of the environment by radioactive substances.
Crucially, the PTBT did not ban all testing. Underground tests remained permitted, provided they did not release radioactive debris beyond the borders of the testing state. This was a compromise born of necessity: because the powers could not agree on verification methods for underground explosions, they simply left that category out. The result was a partial ban, hence the name. The treaty’s wording prohibited any nuclear explosion that would cause radioactive debris to spread outside the territory of the state conducting it.
The significance and limits of the PTBT
The PTBT was a genuine breakthrough. It was the first arms control agreement to win broad international acceptance, and over 120 states eventually became party to it. Its enactment coincided with a measurable decline in atmospheric radioactive contamination, delivering a real environmental benefit. Perhaps most importantly, it proved that the superpowers could negotiate and agree on limits to their nuclear competition.
India was among the early signatories, consistent with its principled support for non-proliferation. India was one of the first nations to sign the PTBT in 1963. Yet the treaty’s limits were obvious. By allowing underground tests, it did not stop the arms race; it merely pushed it underground, quite literally. Nuclear arsenals continued to grow, and the number of states with weapons ambitions remained a worry. A more ambitious instrument was needed to tackle the spread of weapons themselves.
The nuclear non-proliferation treaty: a grand bargain
By the mid-1960s, a frightening prospect loomed. US President John F. Kennedy had warned of a future in which as many as 25 states might possess nuclear weapons. Each new nuclear power increased the statistical chance that these weapons would eventually be used. The NPT was designed to slam the door shut on this expansion.
The treaty was opened for signature on 1 July 1968 and entered into force on 5 March 1970. It is widely described as resting on a “grand bargain” between two groups of states, structured around three pillars.
The three pillars explained
Non-proliferation: This is the heart of the treaty. Under Article I, the recognised nuclear-weapon states pledge not to transfer nuclear weapons to other states or to help any non-nuclear state acquire them. Under Article II, non-nuclear states agree not to receive, manufacture, or otherwise acquire such weapons. The treaty’s central objective is to prevent the spread of nuclear weapons and weapons technology.
Disarmament: In return for non-nuclear states giving up the weapons option, Article VI commits all parties-especially the nuclear-armed states-to pursue good-faith negotiations toward nuclear disarmament and general and complete disarmament. This represents the only binding commitment to disarmament by the nuclear-weapon states in any multilateral treaty.
Peaceful uses of nuclear energy: The third pillar guarantees that all parties have the right to develop nuclear energy for peaceful purposes, such as electricity generation and medical research, with international cooperation. This is overseen through a safeguards system run by the International Atomic Energy Agency (IAEA), which inspects facilities to ensure peaceful programmes are not diverted to weapons.
Who counts as a nuclear-weapon state?
Here lies the most controversial feature of the NPT. The treaty draws a sharp line based on a single date. A nuclear-weapon state is defined as one that manufactured and detonated a nuclear device before 1 January 1967. Only five countries meet this criterion: the United States, the Soviet Union (now Russia), the United Kingdom, France, and China. Every other party to the treaty is classified as a non-nuclear-weapon state.
This arrangement effectively froze the nuclear club at five members. Notably, China and France initially refused to sign the treaty, with China condemning it as discriminatory; both eventually acceded to the treaty only in 1992. The NPT has since become nearly universal, with 191 states having joined-more than any other arms limitation agreement. In 1995, the treaty was extended indefinitely.
Why India refused to sign the NPT
For Indian students, the NPT is impossible to study without understanding why India has steadfastly refused to join it. India did sign the PTBT, but its response to the NPT was the opposite, and the reasons reveal a deep principle in Indian foreign policy.
India’s core objection is that the treaty is discriminatory. By recognising only those states that tested before 1967, the NPT permanently divides the world into nuclear “haves” and “have-nots.” The treaty obliges non-nuclear states to forgo weapons while allowing the established powers to keep theirs. Indian critics famously labelled this system “nuclear apartheid”-a structure that legitimises the arsenals of a privileged few while denying the same right to everyone else.
Several factors hardened this position. China, India’s neighbour and a rival after the 1962 war, conducted its first nuclear test in 1964, comfortably qualifying as a recognised nuclear power under the treaty’s cut-off date. India, facing genuine security threats, was expected to permanently renounce a capability that its neighbour was allowed to keep. India also argued that the treaty demanded sacrifices from non-nuclear states while imposing only vague, unenforceable disarmament obligations on the nuclear powers, who showed little intention of actually giving up their weapons.
India therefore chose strategic autonomy over the treaty. It conducted a “peaceful nuclear explosion” at Pokhran in 1974 and openly tested weapons in 1998, becoming a nuclear power outside the NPT framework. Today only a handful of states remain outside the NPT, including India, Israel, and Pakistan. Importantly, India has consistently framed its position not as opposition to disarmament but as a demand for a genuinely universal and non-discriminatory regime, while adopting a no-first-use doctrine.
Comparing the two treaties
Though often studied together, the PTBT and NPT addressed different problems. The PTBT was fundamentally about the environment and testing: it sought to stop radioactive contamination by banning tests in specific environments. It was narrow in scope but achieved a tangible environmental result.
The NPT was far more ambitious. It targeted the spread of the weapons themselves, creating a comprehensive political and legal framework with verification through the IAEA. Where the PTBT was a single prohibition, the NPT built an entire system of obligations, rights, and institutions that endures to this day as the cornerstone of the global non-proliferation regime.
Both treaties shared a common thread: they emerged from the recognition that unchecked nuclear competition threatened human survival. And both revealed the central tension of arms control-balancing the security interests of powerful states against the principle of equality among nations. The PTBT showed that cooperation was possible; the NPT showed how difficult that cooperation becomes when it touches the core of national power and prestige.
The lasting legacy
More than half a century later, these treaties remain foundational. The PTBT established the precedent that nuclear competition could be subjected to international rules, and it paved the way for the Comprehensive Test Ban Treaty (CTBT) of 1996, which sought to ban testing in all environments, including underground. The NPT continues to function as the bedrock of efforts to prevent the further spread of nuclear weapons, reviewed by its member states every five years.
Yet the unresolved tensions persist. The disarmament promised under Article VI remains largely unfulfilled, and states outside the treaty, including India, continue to challenge its legitimacy. These treaties were not perfect solutions, but they transformed nuclear weapons from an unregulated free-for-all into a managed, if imperfect, international order.
